1. The Contract -- All persons
wishing to book a tour must sign the form. All such persons will be bound
by the conditions that follow. The person on the booking form will here
after be referred to as the client. All bookings are made with Off The
Beaten Track "the company" which sell the tours described in this brochure.
No person has any authority on the company behalf to vary these booking
conditions. The services to be provided are the tour(s) referred to in
this brochure.
2. Payment and acceptance
of booking -- The booking form must be completed and signed by all those
who wish to travel. This form should then be returned to the company or
its agent with a non refundable deposit of 10% of the price. Acceptance
of the clients booking will be confirmed in writing and it is only at this
stage that a contract comes into existence. The balance of the tour price
is due for payment 4 weeks before the departure date. If this balance is
not paid in time the company reserves the right to treat the clientís booking
as canceled. If a booking is made 4 weeks or less before the departure
date then the full amount is payable at the time of booking.
3. Cancellation by the client
-- Any cancellation by a client must be made in writing. The date on which
the letter is received by the company or its agents will determine the
cancellation charges applicable. The cancellation charges are expressed
hereafter as a percentage of the total tour price.
Tours Lasting more
than 4 days:
(a) cancellation
30 days and more before departure : 10%
(b) cancellation 15 days
before departure : 50%
(d) cancellation less than
15 days before departure : 75%
Tours Lasting less than
4 days:
(a) cancellation
before 24 hours : 50%
(b) cancellation less than
24 hours : 75%
4. Cancellation of a
tour by the company -- The company reserves the right to cancel a tour
in the event the minimum number of passengers specified for the tour is
not met, or for any other reason. All tours will not be canceled less than
3 weeks before departure except for major, unusual or unforeseen circumstances
outside the companyís control. When a tour is canceled the client may choose
between full refund of all moneys paid or any alternate tour offered in
lieu by the company. If the alternate tour chosen by the client is of a
lower value then that originally booked then the client is entitled to
a refund of the price difference.
5. Flexibility -- The client
appreciates and acknowledges that the nature of this type of travel requires
considerable flexibility and should allow for alternatives. The outline
itinerary as given for each tour must therefore be taken as an indication
only of what each group may accomplish and not as a contractual obligation
on the part of the company. It is understood that the route, schedules,
itineraries, amenities and mode of transport may be subject to alteration
without prior notice due to local circumstances or events, this may include
sickness or mechanical breakdown, strikes, events emanating from the political
disputes, climate and other unpredictable or enforceable circumstances.
6. Changes -- the company
reserves the right to change any of the facilities, services or prices
described in the brochure before a booking is made. If such a change is
made, the client will be told at the time of booking. While the company
will use its best endeavors to operate all tours as advertised, reasonable
changes in the itinerary may be made where deemed necessary or advisable
by the company.
7. Acceptance of risk --
The client acknowledges that the nature of the tour is adventurous and
that such holidays may involve a significant amount of personal risk.
8. Authority on tour -- At
all times the decision of the companyís tour leader or representative will
be final on all matters likely to endanger the safety and well being of
the tour. The client must at all times strictly comply with the laws, customs
and drug regulations. Should the client fail to comply with the above,
or should the client interfere with the well being of the group then the
tour leader of company representative may order the client to leave without
recourse to any refund.
9. Travel documents -- The
client must be in possession of a valid passport and visa, any information
given by the company on vaccinations, climate, clothing, baggage, special
equipment, etc. Is given in good faith but without responsibility on the
part of the company.
10. Insurance -- Clientís
responsible for obtaining sufficient personal travel insurance. This must
include personal accident, medical expenses, loss of effects, repatriation
costs, air ambulance and all other expenses which might arise as a result
of loss, damage, injury, delay or inconvenience occurring to the client.
Insurance source should be aware of type of travel to be taken.
11. The contract is to be
construed, and any dispute between the parties determines, under the law
of India, any such dispute shall be subject to the sole jurisdiction of
the court of India.
12. Local condition -- Due
to political and cultural differences, as well as generally tougher physical
condition, travel to the areas we visit involves risks other then those
we normally take. It is important that clients make themselves aware of
the risks involved, and are responsible for making their travel plans accordingly.
13. Claims and complaints
-- If a client has a complaint against the company the client must first
inform the tour leader or company representative whilst on the tour in
order that the leader or representative can attempt to rectify the matter.
Any further complaint must be put in writing to the company within 30 days
of the end of the tour.
